We have a team which has been practicing the law relating to the prevention of sexual harassment at the workplace, well before the relevant statute i.e. The Sexual Harassment of Women at Workplace (Prevention, Prohibition and Redressal) Act, 2013 (“Act”) came into being. As a part of our services in this practice area, our team advises clients on issues of sexual harassment, their obligations in maintaining safe and congenial workplaces and assists clients in conducting enquiry(ies) into complaints of sexual harassment at the workplace, pressing into service, skills acquired during its long-standing trial court experience.

Our practice in the area includes:

  • Rendering advisory services on all aspects of the law relating to sexual harassment at the workplace including pertaining to allegations of sexual harassment, the applicability of the statute to women and protection for persons of all genders basis gender neutral policies adopted by the organization, constitution of the Internal Committee (IC) for various clients, following due process whilst conducting enquires pertaining to sexual harassment, any issues/concerns which may be faced by the IC/employer / concerned parties, etc. and implementing workplace policies.
  • Drafting/revising/vetting policies on sexual harassment at the workplace and updating the same periodically.
  • Conducting awareness and sensitization workshops for employees and conducting orientation programs for the IC and awareness sessions to apprise the employer(s) of their obligations and role in compliance with the Act and handling situations arising from allegations/complaints of sexual harassment. 
  • Ensuring compliances and documentation, as mandated under the Act.
  • Extending services as an external member on the Internal Committee for various clients and ensuring that due process is followed whilst conducting the enquiry hearings and that that the findings arrived at by the IC are as per applicable laws and policies.
  • Assisting the ICs of various organizations for inter alia conducting the enquiry process, documentation of the enquiry process and arriving at findings in complaint cases, drafting and/or reviewing of the findings report and providing guidance on the steps that follow the conclusion of the enquiry process.
  • Guiding our clients so as to ensure that they are in compliance with the Act, the rules framed thereunder, and guidelines and notifications issued by the state / central government.
